There are now over 100,000 attorneys in the State of Florida alone. A growing number of these attorneys are adding Elder Law to their areas of specialty. Unfortunately, only a few are truly experts at Medicaid Planning. Even certified Elder Law Attorneys who are “Board Certified” in elder law are often lacking in the necessary expertise to execute an entire Medicaid plan and application with optimal results. Think book smart versus street smart!
None-the-less, an Elder Law Attorneys Medicaid Planning Assistance is crucial regardless of the state in which Medicaid is being applied for. Medicaid planning generally involves matters that may include real estate law, tax law, investment considerations, insurance law, probate law, traditional estate planning and other areas of the law. Therefore, navigating a Medicaid plan without legal advice is not advisable and if you are being assisted by a Medicaid application company without legal assistance, it could be illegal.
The natural question is; Why wouldn’t I use an attorney for the Medicaid Planning AND Medicaid application process?
There are many reasons why you should limit an Elder Law Attorneys Medicaid Planning assistance to legal advice and legal documents and not include the attorney in the administrative process of repositioning assets and income or in filing the application and dealing with Florida’s Department of Children and Families.
1) Elder Law Attorneys Medicaid Planning Assistance deal with other services provided to clients which often include, but are not limited to;
a. Probate
b. Estate Planning
c. Elder Exploitation
d. Elder Abuse
e. Guardianship
f. Resident Rights
g. Nursing Home Abuse
h. And much more
Most attorneys usually pass much of the above work to an assistant who will also be handling the administrative process of Medicaid Planning and the Medicaid Application.
It is virtually impossible for one person to handle all the details of such a large array of legal issues and be effective at all of them. There are a plethora of details, time standards, rules, and regulations not to mention the insanely long hold times with The Department of Children and Families.
2) Because attorneys practice in so many other areas and are typically geographically limited, they often only see a few Medicaid cases per year. This minimal exposure limits acquisition the development of true expertise.
3) Apart from Platinum, there is no software on the market specifically designed to track and maintain all the details of a Medicaid case. This limits Elder Law Attorneys who offer Medicaid Planning Assistance to a manual or semi-manual process that leaves considerable room for error.
4) Attorneys are typically difficult to gain access to when you have questions.
5) Attorneys generally do not communicate with care providers to help the provider understand where in the process the Medicaid application is. This creates anxiety for the provider and results in unnecessary pressure on the family.
1) Two heads are better than one.
2) Platinum helps attorneys understand advanced planning techniques that can save families tens of thousands of dollars in taxes.
3) Book smarts (attorneys) and street smarts (Platinum Benefit Services are combined.)
4) Attorneys that work with Platinum help families save more bottom-line assets than are usually saved when an Elder Law Attorney’s Medicaid Planning Assistance is provided solo.
5) Platinum has gained considerable expertise with more than 14,000 (as of 2023) Medicaid applications approved. That is a lot of experience!
6) Platinum has spent considerable effort and expense building Elder Law and Medicaid industry specific software that aids in the attorney and Platinum in keeping up with a case from beginning to end.
7) Platinum provides progress reports to providers on a weekly basis.
8) Platinum reports to the client on a weekly basis.
9) Platinum is available to answer your questions.
10) Platinum assigns a team to complete your case.
11) Platinum provides a Money Back Guarantee the attorney cannot provide (do you want to keep this?).
12) Every Google review is specifically regarding only Medicaid Planning Assistance and Application approval.

The Florida Medicaid program provides medical coverage for Florida residents who meet the program's eligibility requirements. Once an individual is approved for Medicaid in Florida medical bills will be paid, primarily by Medicaid.
These bills include not only nursing home care, but also hospital stays, home health care, home and community-based services, hospice, transportation, dental and vision care, community behavioral health, and prescription medications. (although in some cases, Medicare coverage may overlap this coverage).
The following services are required to be offered by all states, including Florida, under Medicaid:
The following services are optional; however, most states will also offer them through Medicaid:
While Medicaid covers many services, there are a number of items that are not provided by this program. Medicaid does not cover the following services:
It is important to note that some exceptions may apply. However, exceptions must typically be medically necessary and ordered by a physician before the exception can be applied.
Unlike Medicare, there are some fairly strict financial rules with which one must comply in order to qualify for Medicaid's nursing home benefits. Yet, for those in need of this coverage, there are numerous strategies and combinations of strategies that can be used to qualify.
By using these strategies properly, with the guidance of a professional, proper care for a loved one can be obtained while preserving assets and income for a healthy spouse and / or other family member(s).
If an applicant is living in their home (i.e., not in a nursing home), the Medicaid program refers to them as living "in the community." In this case, Medicaid will still pay for certain services if the person qualifies. The basic test is whether the individual would otherwise require the level of care provided in a hospital, nursing facility, or intermediate care facility for the mentally handicapped. In other words, an applicant for home care must meet the level of care for some type of institutionalized care.
Many states - including Florida - have a program called "HCBS" This stands for Home and Community Based Services. Until recently, a state wishing to provide Medicaid assistance to elderly people outside the nursing home had to apply to the federal government for a specific waiver of the usual Medicaid rules. However, beginning in 2007 as a part of the Deficit Reduction Act, all states are now eligible to offer this program without first having to obtain a federal waiver by submitting a state plan amendment setting forth the scope of the new HCBS program they wish to implement.
In general, HCBS will pay for the following in-home services:
It is important to note that room and board for the HCBS recipient are not covered and that home care is very limited even when full qualification is obtained.
It is true that an applicant must be poor in countable assets. However, there are many asset categories that are not countable. Therefore, the requirement of being destitute is a misnomer.
